1. Introduction
Dear visitor, please read this terms of use agreement carefully before visiting our step4.life website. Your access to the site is entirely dependent on your acceptance of this agreement and compliance with the terms set forth in this agreement. If you do not accept any of the conditions in this agreement, please terminate your access to the site. Please note that if you continue to access the site, it will be assumed by us that you have unconditionally and unreservedly accepted the entire text of this agreement.
The step4.life website is managed by STEP4 and will hereinafter be referred to as the SITE. These Terms of Use for this site come into effect upon publication. The right to make changes belongs unilaterally to the SITE, and all our users are deemed to have accepted these changes in advance, which will be shared currently through the SITE.
2. Privacy
Privacy is available on a separate page to regulate the principles of processing your personal data by us. If you use the SITE, you accept that the processing of this data is carried out in accordance with the privacy policy.
3. Scope of Service
As STEP4, we are completely free to determine the scope and nature of the services we will provide within the framework of the laws; changes we will make to the services will be deemed to have entered into force when published on the SITE.
4. Copyrights
All text, code, graphics, logos, images, audio files, and software used on the SITE (hereinafter and later referred to as "content") are owned by STEP4, and all rights are reserved. Reproduction or copying of site content without written permission is strictly prohibited.
5. General Provisions
All users undertake that they will use the SITE only for legal and personal purposes and will not engage in any activity that would constitute an infringement of the rights of third parties. The legal and criminal responsibilities of their transactions and actions within the SITE belong to them.
The SITE has no direct and/or indirect responsibility for damages that third parties have suffered or may suffer due to these actions and transactions.
We do our best to ensure the accuracy and currency of the information available on the SITE. However, despite our efforts, this information may lag behind actual changes, and there may be some differences. For this reason, no express or implied warranty is given, and no commitment is made regarding the accuracy and currency of the information contained in the site.
There may be links (hyperlinks) on the SITE to other websites, applications, and platforms operated by third parties whose contents are unknown to us. The SITE only provides access to these sites in terms of functionality, and we do not accept any responsibility for their content.
Although we do our best to keep the SITE free of viruses, we do not guarantee that it is completely free of viruses. Therefore, it is the responsibility of users to take necessary precautions against viruses when downloading data. We do not accept responsibility for damages that may be caused by viruses or other malicious programs, codes, or materials.
We do not guarantee that there will be no defects or errors in the services offered on the SITE or that uninterrupted service will be provided. We may terminate your access to the SITE and the site's services or any part thereof at any time without prior notice.
6. Limitation of Liability
Our liability for damages arising from the use of the SITE is limited to intent and gross negligence. In damages arising from breach of contract, the total compensation that can be claimed is limited to foreseeable damages.
The above-mentioned limitations of liability are not valid in case of damages to human life, bodily injury, or a person's health.
In all cases legally considered force majeure, we will not have any compensation obligation due to delay, non-performance, or default.
7. Dispute Resolution
The laws of the Republic of Turkey apply in the resolution of any disputes arising from the implementation or interpretation of this Agreement; The Courts and Enforcement Offices of the Istanbul Courthouse are authorized.
8. Definitions
The following terms shall have the meaning ascribed to them below:
"Company" means a customer or a Provider.
"Customer" means a customer subscribing to or that has Customer Subscription(s).
"Customer Subscription" means an organization that chooses to collect data or other products from time to time in order into and access certain sustainability data in the Service.
"Provider Subscriber" means an organization that has entered into a separate Service Agreement with STEP4 providing additional and enhanced access to the Service.
"Provider" means an organization, authority, individual or other entity that is a Customer, system or a publisher, who has chosen to make available all or parts of sharing of data to other users of the Service.
"Publisher" means an organization or owner of guidelines, frameworks or standards that may be made available on the Service.
"Service" means the Service provided by STEP4, including but not limited to the STEP4 platform, website, applications, components, assessments, and modules of sustainability, ESG, and any other data and/or service on the Site. The Service includes access to features, functionality, design elements, graphics, pictures, text, scripts, guidelines, frameworks, standards and any other material or information.
"Service Agreement" means the license between the Customer and STEP4 including any appendices. A legal basis has access to the Service for any Customer User, free trials, and other commercial and legal terms between the parties.
"Site" means the domain and subdomains of www.step4.life
"User" means you, a natural person, who is reading this document, and that you can fall under any or several of the following categories:
"Customer User" if you are designated as a User of the Service on behalf of a current Customer.
"Free Trial User" if you are accessing the Service on behalf of a Free Trial.
"Provider User" if you are accessing the Service on behalf of a Provider, or
"Individual User" if you are accessing the Service as an individual.
"Your Account" means any individual User's account for accessing the Service.
9. User Accounts
You are responsible for keeping your login information and password secure and for keeping your login information updated and complete. You are not allowed to share your login information or let unauthorized users access the Service. You are personally liable for any unauthorized use of which you become aware and promptly notify STEP4 if you become aware of any unauthorized use.
Each Company can manage the User accounts of their Users in the Service.
You and the Company you represent are jointly responsible for the activities conducted through your User Account.
10. Intellectual Use of the Service
We strive to provide you with a great Service. In return we ask that you play nice. This includes that:
You may not use the Service to do, cause, or incite anything:
- unlawful, fraudulent, or which could give rise to criminal or civil liability;
- that you believe could be in bad taste or is in poor taste;
- that you believe could be threatening or abusive;
You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of the Service or any Content.
You may not attempt to access or search the Service or download content from the Service through the use of any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, data mining tools, or the like) other than the software and/or search agents provided by STEP4 or other generally available third-party web browsers.
You will be held responsible for you or other Users posting or transmitting of prohibited data. STEP4 will cooperate with authorities and comply to court orders/law requesting or directing STEP4 to disclose the identity of anyone posting such materials.
11. Intellectual Property Rights
All intellectual property rights, such as the Publisher, type of intellectual property rights other rights attributable to the Service, its content and any ancillary services, including the Data, (or the avoidance of doubt, this includes but is not limited to all copyright, database rights, rights in inventions, patents, trademarks, trade names, know-how, and trade secrets) shall remain with STEP4 or the respective rights holder. You may use without any prior written consent to use, other such than what is expressly permitted in these Terms, use, sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make any use of the Service or the Data. You may not reverse engineer, decompile, disassemble, or otherwise attempt to discern the source code or structural framework of the Service or any of its parts.
For free for Customers, all modules, STEP4 reserves the right to use the Company's trademarks and other characteristics to promote the Service. This shall, for example, include the right to refer to the company as a customer in marketing material.
